Terms of Service

These Terms of Service ("Terms") govern your use of the AdsForge platform operated by AdsForge ("we", "our", "us"). By using AdsForge, you agree to these Terms.

1. Service Description

AdsForge is an AI-powered advertising management platform that helps e-commerce businesses create, manage, optimize, and scale their Meta (Facebook/Instagram) advertising campaigns. Features include AI ad copy generation, creative asset management, performance analytics, automated optimization, and campaign deployment.

2. Account Registration

• You must be at least 18 years old to use AdsForge.
• You must provide accurate and complete information when creating your account.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.

3. Connected Services

Meta Ads Account: By connecting your Meta Ads account, you authorize AdsForge to access and manage your advertising data, create and modify campaigns, ad sets, and ads, and read performance metrics on your behalf. You can revoke this access at any time.

E-Commerce Store: By connecting your store, you authorize AdsForge to access your product catalog for ad creation purposes.

Third-Party API Keys: Any API keys you provide (AI models, image generation services) are used solely to call those services on your behalf. You are responsible for the costs incurred on those third-party services.

4. Acceptable Use

You agree NOT to:

• Use AdsForge to create ads that violate Meta's Advertising Policies
• Use the platform for any illegal or fraudulent purposes
• Create misleading, deceptive, or harmful advertising content
• Attempt to reverse-engineer, copy, or redistribute the AdsForge platform
• Share your account credentials with unauthorized third parties
• Use automated tools to scrape or extract data from AdsForge
• Exceed reasonable usage limits or abuse API rate limits

5. Subscription & Billing

• AdsForge offers subscription plans billed monthly or annually.
• Prices are displayed in USD and may vary by plan.
• Subscriptions auto-renew unless cancelled before the renewal date.
• You may cancel your subscription at any time. Access continues until the end of your billing period.
• Refunds are provided at our discretion for unused portions of annual subscriptions.
• We reserve the right to change pricing with 30 days' notice.

6. AI-Generated Content

AdsForge uses artificial intelligence to generate ad copy, analyze performance, and provide recommendations. You acknowledge that:

• AI-generated content is provided as suggestions and should be reviewed before use.
• You are solely responsible for the content of ads published through your Meta Ads account.
• AI recommendations (budget adjustments, optimizations) are suggestions — you control whether to apply them.
• We do not guarantee specific advertising results, ROAS, or performance outcomes.

7. Automated Actions

AdsForge can perform automated actions on your ad account (budget adjustments, ad pausing, campaign creation) when you explicitly enable these features. You understand that:

• Automated features are opt-in and can be disabled at any time.
• You are responsible for reviewing and monitoring automated actions.
• We are not liable for ad spend incurred through automated optimizations.
• Budget adjustments are capped at safe thresholds to prevent unexpected spending.

8. Intellectual Property

The AdsForge platform, including its design, code, algorithms, and documentation, is owned by AdsForge. Ad copy and creative content generated for your products belong to you. You grant us a limited license to use your data solely to provide the service.

9. Limitation of Liability

To the maximum extent permitted by law:

• AdsForge is provided "as is" without warranty of any kind.
• We do not guarantee uninterrupted or error-free service.
• We are not liable for advertising spend, lost revenue, or business losses arising from use of the platform.
• Our total liability is limited to the amount you paid for the service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify AdsForge against any claims, damages, or expenses arising from your use of the platform, your advertising content, or your violation of these Terms or Meta's policies.

11. Termination

We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or fail to pay subscription fees. Upon termination, your data will be retained for 30 days before deletion, during which you can request an export.

12. Changes to Terms

We may update these Terms with 30 days' notice. Material changes will be communicated via email. Continued use after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of Malaysia. Any disputes shall be resolved in the courts of Malaysia.
